These terms and conditions (the “Terms and Conditions”) govern your entry into and participation in the promotion. Please read these terms carefully before entering, as by entering, you are deemed to have accepted and agreed to be bound by these Terms and Conditions.

In the event of any conflict or inconsistency with any other communications related to the promotion, including advertising or promotional materials, these Terms and Conditions will take precedence. Please retain a copy of these Terms and Conditions for your information.

ELIGIBILITY

1. This promotion is open to residents of the UK, except for employees of the Promoter and their immediate families, associated agents or anyone else professionally connected with the promotion.

2. No purchase necessary. Internet connection and valid email address and mobile registration required.

3. Entrants must be aged 18 years or over at the date of entry.

4. Maximum one entry per person, per day. Only one prize can be won per week, per person.

5. Bulk entries, entrants using email addresses, mobile numbers or entering via agents, third parties, organised groups, syndicates or aliases, or entries automatically generated by computer, will not be accepted. Entries received by any means other than as specified in these Terms and Conditions (see Condition 7 below) will be rejected. Any person persistently trying to circumvent the entry process will be disqualified immediately. No incomplete, corrupted entries or multiple entries form the same person beyond the daily limit will be accepted. Entries must be made directly by the person entering the promotion. Only genuine valid entries will be considered.

PROMOTIONAL PERIOD

6. The promotion will run from 00:00:01 on 07.11.24 to midnight on 02.01.25 (the “Promotional Period”). Only entries submitted during the Promotional Period will be valid and included in the promotion.

8. Only valid entry information will be accepted. All entry information is subject to verification and interrogation.

9. In the event of suspicious activity, the Promoter reserves the right to request and gather information or obtain further evidence to confirm the legitimacy of the entry / win.

11. There are 1,641 prizes in total, as detailed, that are available to be won throughout the entire promotion, allocated across 8 weekly draws and 1 final end of promotion prize draw.

12. End of promotion prize - trip to Hollywood for 2: Prize includes 2 return flights from the winner’s nearest major airport to Los Angeles. Return airport & event transfers. 3 night hotel stay in Los Angeles, breakfast included. Behind the scenes Warner Bros. Hollywood Studios Tour and a 2 day Hop On, Hop Off Bus Tour ticket for 2 adults. Dates of travel are weekends between 07.03.2025 – 02.03.2026, excluding national holidays in the UK and the USA. These travel periods cannot be amended or extended. Winners will forfeit the prize if they fail to travel before 27.02.2026. A minimum of sixty days’ notice is required before the chosen departure date. Prize is subject to availability, has no cash alternative, is non-transferable and non-refundable. Once the trip is booked no changes are permitted. At least one person travelling must be aged 18 or over. Hotel is based on two people sharing one room. The hotel will take a credit card pre-authorization or cash deposit to cover any incidentals. Winner and his/her guest are solely responsible for all other meals and expenses not specifically set forth herein. Minimum age limit for the Warner Bros. Studio Tour Hollywood is 5 years old. Travel insurance is included, but pre existing conditions are not covered. Maximum age for cover 75 years old. You are advised to seek independent insurance cover in these circumstances. Winner and his/her guest must have and are responsible for valid e-passports (biometric) and visas/permissions if applicable. Winner and his/her guest must possess a valid ESTA issued via the US Visa Waiver programme: https://esta.cbp.dhs.gov. Only winner/guest with valid visas do not require this. Winners and guest travel at their own risk and, if for any reason any aspect of this promotion is not capable of running as planned, including war, terrorism, state of emergency, pandemic, or any other kind of disaster, tampering or computer virus, the Promoter reserves the right to cancel, terminate, modify or suspend the promotion or suspend, substitute or modify a prize, subject to any written directions from a relevant regulatory authority. Except for the one guest permitted to you as part of your prize, you are not allowed to bring any additional family members or guests on the Prize trip. Your guests may not be selected through any further contest, promotion or commercial event. Once selected, your guest may not be changed without the express consent of the Holiday Prize Provider, which the Holiday Prize Provider may grant or withhold in its sole discretion. Any potential winner and his/her proposed guest will be required to sign a prize acceptance and release form in order to be eligible to win and/or participate in the prize.

13. Prizes are strictly non-transferable and must not be sold, auctioned nor advertised for sale whether on the internet, in newspapers or elsewhere. Any person found in breach of this term will be disqualified and the prize withdrawn. No alternative prizes will be available in whole or in part, except in the event of circumstances outside the reasonable control of the Promoter, whereby the Promoter reserves the right to substitute the prizes with prizes of equal or greater value. The prizes will only be awarded directly to the winners.

14. In the event of circumstances outside the reasonable control of the Promoter, or otherwise where fraud, abuse, and/or an error (human or computer) affects or could affect the proper operation of this promotion or the awarding of the prize, the Promoter reserves the right to suspend or cancel the promotion or amend these Terms and Conditions, at any stage, with no liability to any entrants or third parties, but will always endeavor to minimise the effect to participants in order to avoid undue disappointment.

WINNER SELECTION AND NOTIFICATION

15. For each weekly draw, 215 winners will be picked at random from all valid entries received for that week using an independently supervised process. Winners will be picked on the Thursday following the end of each weekly draw. For example, for the first weekly draw, 215 winners will be picked at random on 14.11.24 from all valid entries received between 07.11.24 – 13.11.24.

16. Tier 1 winners will receive an email to the email address provided upon entry containing their digital Amazon.co.uk Gift Card link. Tier 2 and 3 winners will receive an SMS confirmation that their prize will be dispatched to the postal address provided upon entry and will arive within 28 days.

17. The end of promotion prize draw will take place by 08.01.25. The winner will be selected from all the entries from the Promotional Period and contacted via email by the Holiday Prize Provider, to the email address provided at point of entry. Entries of winners of prizes in Tiers 1-3 are not excluded from the end of promotion prize draw.

18. End of promotion prize redemption: The winner of the end of promotion prize draw will have their name and contact details shared with the Holiday Prize Provider for administration of the prize. The Holiday Prize Provider will make reasonable efforts to contact the winner to receive the relevant information to allow fulfilment of the applicable prize. Regular reminders (up to 3) will be sent out to the winner via email. Inaccurate information may result in the prize being forfeited. If a winner has not responded to notifications after 14 working days or if a selected winner is ineligible, otherwise in breach of these Terms and Conditions or unable to or declines to take up the prize for any reason, the Promoter reserves the right to withdraw the prize and to reallocate the prize by selecting a new winner from all remaining entries in accordance with the process described in these Terms and Conditions.

19. The digital Amazon.co.uk Gift Cards are subject to the issuer’s terms and conditions of use which are accessible at www.amazon.co.uk/gc-legal. Restrictions apply. Winners will need an existing amazon.co.uk account or need to register for one to be able to redeem their digital Amazon.co.uk Gift Card code. The digital Amazon.co.uk Gift Card is available to be redeemed up to 10 years from the date of claim. Amazon.co.uk (nor any other third party brand referenced) is not a sponsor of this promotion. 20. Winners should retain their SMS and email notifications for prize verification purposes. The Promoter does not accept any responsibility in the event a winner does not receive their prize for whatever reason, including in the event that a winner provides incorrect contact details.

21. Insofar as is permitted by law, the Promoter and its agents will not in any circumstances be responsible or liable to compensate entrants for any losses that may be incurred as a result of entering the promotion and the Promoter does not accept any liability for any loss, damage, personal injury or death occurring as a result of a winner’s acceptance of a prize except where such damage or loss is caused by the negligence of the Promoter or its agents. The winners’ statutory rights are not affected.

22. No correspondence: The decision of the Promoter regarding any aspect of the prize draw is is final and binding and no correspondence will be entered into, except with the prize winners.

DATA PROTECTION AND YOUR RIGHTS

23. The Promoter takes data protection seriously. Personal data will be treated in confidence in accordance with the Promoter’s Privacy Policy at https://www.mars.com/privacy, the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.

GENERAL INFORMATION

24. A list of winners’ surnames and counties of residence is available on request. Please post your request and a stamped addressed envelope to: M&MS / Red One Asda promotion, Consumer Care, Mars Wrigley Confectionery UK Limited, 3D Dundee Road, Slough, Berkshire, SL1 4LG within 3 months of the promotion close date. Should a winner wish to exercise their right to object to their information being made available, or request that it be limited in scope, they should contact the Promoter by emailing contact@ukmw.mars.com. The Promoter may nevertheless disclose information to regulatory authorities if required by law to do so.

25. In the event a winner requests for their personal data, including phone number and address details, to be deleted or limited in scope, the Promoter cannot be held responsible if such request means that it is unable to complete delivery of the winner's prize or assist them. The full name and contact details of the winners will be retained for 30 days after the relevant prize has been fulfilled to allow the Promoter to deal with any queries from the winners, and always in accordance with the Promoter’s Privacy Policy. Winners’ surnames and county details will be retained for the purposes of administering this promotion and may be available to members of the public, subject to Condition 24, and/or a regulator.

26. Winners may be required, if they consent, to take part in reasonable publicity relating to this promotion without further remuneration.

27. The Promoter is not responsible for any entries which fail to be registered or are delayed for any technical or other reason whatsoever.

28. The Promoter reserves the right to verify the winning entries including by asking the winners’ identity (which they must provide within 14 days but which will not be retained following verification by the Promoter and redemption of the prize), including proof of age, and may refuse to award a prize or withdraw a prize entitlement and/or refuse further participation in the promotion and disqualify a participant where there are reasonable grounds to believe there has been a breach of these Terms and Conditions (including entry requirements) or otherwise where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means.

29. The Promoter may at its absolute discretion disqualify any participant found to be tampering with the application process or operation of the website or to be acting in any manner disruptive to the promotion.

30. Sometimes, through reasons outside of the Promoters control, the website (as with any website) may not be accessible. The Promoter cannot guarantee continuous, uninterrupted access to the website. No responsibility will be accepted for any difficulties in entering, claiming or any entries/claims delayed or corrupted. The Promoter will have no liability for any loss arising out of such an event.

31. Limitations of liability: Insofar as permitted by law, neither the Promoter nor the promotional parties assume any responsibility or liability for:

• Any faulty, incorrect, errors or failed electronic data transmissions;
• Communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers or providers utilised in any aspect of this promotion;
• Inaccessibility or unavailability of the internet or the website or any combination thereof; and
• Insofar as permitted by law, any injury or damage to participants or to any other person (or their property) which may be related to or resulting from any attempt to participate in the promotion.

32. If any Condition of these Terms and Conditions is determined to be illegal, invalid or otherwise unenforceable, then it shall be deemed deleted from these Terms and Conditions. The remaining Conditions shall be unaffected and remain in full force and effect.

33. This promotion and these Terms and Conditions (and any disputes/claims arising out of or in connection with them) shall be governed by and construed in accordance with English law and the parties to any dispute or action shall submit to the jurisdiction of the English and Welsh courts. However, if you are resident in Scotland or Northern Ireland, you may bring your claim before the Scottish or Northern Irish courts (respectively), if you wish.
